Regulations of the Melanstar sp. z o.o. Online Store

General Provisions
- These Regulations constitute an integral part of the sales agreement concluded between the Seller and the Customer who places an order in the Store.
- Each Customer, by making a purchase of goods offered by the Seller, is obliged to familiarize themselves with and accept the provisions of these Regulations.
- Sales are conducted via the Internet between the Customer and the Seller.
- The subject of the sale is Melanstar-branded products presented on the Store’s website. The Seller reserves the right to make changes in the Store’s assortment and/or product technical data. The Seller is not responsible for editorial errors.
- In accordance with applicable laws, Melanstar sp. z o.o. reserves the right to limit the provision of services through the online store to individuals who have reached the age of 18. In such cases, potential Customers will be informed accordingly.
- The information about products provided on the Store’s website, particularly their descriptions, technical specifications, and usage features, as well as prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
Terms of Use of the Online Store
- To ensure the security of communication and data transmission in relation to the services provided on the website, the online Store takes appropriate technical and organizational measures, suitable to the degree of risk posed by the services provided, particularly to prevent the unauthorized acquisition or modification of personal data transmitted over the Internet.
- The Customer is obliged to:
- not provide or transmit content prohibited by law, such as content that promotes violence, defames others, or violates personal rights and other rights of third parties;
- use the online store in a way that does not disrupt its functioning, particularly by not using specific software or devices;
- use the online store in compliance with applicable Polish laws, the provisions of these Regulations, and general principles of Internet usage.
Procedure for Concluding a Sales Contract
- The Customer can place orders 24/7, but orders are fulfilled only on business days from Monday to Friday. Orders placed on weekdays after 12:00 PM, or on Saturdays, Sundays, or public holidays, will begin processing on the next business day.
- Products are selected by adding them to the cart.
- During the ordering process—until the moment of clicking the “Order with an obligation to pay” button—the Customer has the option to modify the entered data and selected products by following the displayed instructions.
- To place an order, the Customer should:
- log in to their account (optional);
- select the product and click “Add to Cart”;
- choose the payment and delivery method available in the Store;
- provide the necessary details for order fulfillment, such as the recipient’s name and delivery address, if they differ from the details provided during registration;
- enter data necessary for issuing a VAT invoice, including the address.
After providing all the necessary information, the Customer will be presented with a summary of the order. The order will be placed upon payment. Sending the order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with Melanstar sp. z o.o. for the purchase of goods from the store at https://melanstar.com/, in accordance with these Regulations. The Customer will receive a confirmation email containing details of the order and the concluded Sales Agreement.
Prices and Payment Methods
- Product prices are listed in Polish złoty (PLN) and include all components, including VAT.
The gross price of products does not include delivery costs. - The total value of the order consists of the price of the products and the cost of delivery. This information is provided in the order summary.

- By accepting these Regulations, the Customer consents to the issuance and sending of invoices electronically, in accordance with Article 106n of the Act of March 11, 2004, on the tax on goods and services (consolidated text: Journal of Laws of 2020, item 106, as amended). Consent to receive an electronic invoice is tantamount to waiving the receipt of a paper invoice.
- The Seller is not responsible for incorrect data provided by the Customer during the order process, particularly for the issuance of VAT invoices.
Delivery of Goods, Order Fulfillment
- Delivery of products is limited to the territory of Poland and takes place at the address provided by the Customer during the order placement process. International delivery is possible after prior consultation with the Store’s customer service and approval of shipping costs by the Customer.
- Orders can only be placed if the product is available.
- Within Poland, deliveries are fulfilled by InPost courier services.
- Delivery costs depend on the dimensions and weight of the package.

5. The Seller is not responsible for any extended delivery times or lack of delivery of the order due to incorrect or incomplete data provided by the Customer, including incorrect or incomplete delivery address provided by the Customer.
6. The delivery time within Poland is from 2 to 7 business days from the day the Customer sends the Order.
Right of Withdrawal

- The Customer, who is a Consumer, has the right to withdraw from the Agreement within 14 days. The Consumer has the right to withdraw from this Agreement within 14 days without providing any reason. The withdrawal period expires after 14 days from the day of receiving the goods (receipt of the package).
- To exercise the right of withdrawal, you must inform us of your decision to withdraw from this Agreement by an unequivocal statement (for example, a letter sent by post or by email).
- You may use the withdrawal form template, but it is not obligatory.
- To meet the withdrawal deadline, it is sufficient for you to send your information concerning the exercise of your right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal

- In the event of withdrawal from this Agreement, we will refund the cost of the purchased goods and the cost of one-way shipping without undue delay and in any case no later than 14 days from the day we were informed of your decision to exercise the right of withdrawal from this Agreement.
- The direct costs of returning the goods are borne by the Customer.
- We will make the payment refund using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise.
Carrier Complaints

- Complaints related to carrier issues and order discrepancies should be submitted exclusively by email to info.melanstar@gmail.com.
- The Seller recommends that the email complaint includes the following information: identifying details of the Buyer, a brief description of the situation. In the case of delivery by the carrier of a damaged/delivered package with damaged goods inside, you should: prepare a damage report, write it in the presence of the courier at the time of delivery or within no more than 1 hour from the time of delivery. You should then notify the Seller electronically of the situation, send the prepared damage report and include attached photos documenting the damage.
Complaints Regarding Goods

- Melanstar sp. z o.o., as the Seller, is liable to the Customer who is a Consumer under Article 22[1] of the Civil Code for defects as specified in the Civil Code, in particular Articles 556 and 556[1] – 556[3] and subsequent Civil Code provisions.
- Complaints resulting from the violation of statutory rights or based on this Regulation should be sent to info.melanstar@gmail.com. The Seller undertakes to review each complaint within 14 days.
- Melanstar sp. z o.o., the owner of the online store, is the manufacturer and seller of the goods offered in the store. The Manufacturer and Seller are responsible for the warranty of the sold goods for a period of 2 years for stainless steel sinks and washbasins and 1 year for kitchen and bathroom accessories.
- All goods offered in the Store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market.
- In the case of a defect in the goods purchased from the Seller, the Customer has the right to complain about the defective goods based on the warranty or guarantee, if a guarantee has been provided.
- When using the warranty, the Customer may, under the terms and within the deadlines specified in the Civil Code:
- declare a reduction in the price
- in the case of a significant defect – declare withdrawal from the agreement
- demand replacement of the item with a defect-free one
- demand removal of the defect
- The complained goods should be sent to the Seller’s correspondence address:

- In the case of accepting the complaint, the Seller, no later than 21 days from the day the Customer is informed about the acceptance of the complaint, will refund all payments made by the Customer, including the costs of delivering the item.
Complaints Regarding Electronic Services

- The online store takes steps to ensure the proper operation of the service and the store’s websites, to the extent resulting from current technical knowledge and undertakes to rectify any technical irregularities reported by Customers within a reasonable time.
- Irregularities related to the operation of the service and the store’s websites may be reported by the Customer in writing to: Marii Świątkiewicz 51 lok A52, 05-552 Mroków, Poland, or by email to: info.melanstar@gmail.com.
- In the complaint, the Customer should describe the type and date of the irregularity related to the functioning of the Store.
Dispute Resolution and Final Provisions

- A Customer who is a Consumer may, if interested, use non-judicial methods of handling complaints and pursuing claims. Disputes regarding online purchases can be resolved through mediation proceedings before the Provincial Inspectorates of Trade Inspection or through arbitration proceedings before the arbitration court at the Provincial Inspectorate of Trade Inspection. The Consumer may also use other methods of extrajudicial dispute resolution and, for example, submit their complaint through the EU Online Dispute Resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr/
- In matters not regulated by these Regulations, the provisions of the Civil Code, the Act on Providing Services by Electronic Means, and other applicable Polish law regulations shall apply.
- The Seller reserves the right to make changes to the Regulations for important reasons such as changes in legal regulations concerning electronic services, consumer rights, data protection, and other regulations applicable to online sales, changes in the Seller’s business activity in terms of address details, company (name) of the Seller, or legal form of the Seller’s business, as well as in the case of technical changes related to the functioning of the Store, introduction of new services, or changes in the range of offered services. Changes to the Regulations come into effect 2 days after the amended Regulations are made available on the Store’s website, with the exception that transactions started before the changes come into effect are conducted under the previous terms. The Customer accepts changes to the Regulations by clicking/confirming the message on the Store’s login page.
Instructions for Completing the Withdrawal Form

- In the case of an agreement obliging the transfer of ownership of multiple goods delivered separately: “in which you took possession of the last item or in which a third party other than the carrier and indicated by you took possession of the last item.”
- In the case of an agreement obliging the transfer of ownership of goods delivered in batches or parts: “in which you took possession of the last batch or part or in which a third party other than the carrier and indicated by you took possession of the last batch or part.”
- In the case of agreements for regular delivery of goods for a fixed term: “in which you took possession of the first item or in which a third party other than the carrier and indicated by you took possession of the first item.”
- Please enter your surname, full postal address, and, if available, your telephone number and email address.
- You may also complete and submit the withdrawal form or any other unequivocal statement electronically on our website. If you use this option, we will promptly send you confirmation of receipt of the withdrawal information.
- We may withhold the refund until we have received the goods or until we receive proof of their return, whichever occurs first.
- Please return or hand over the goods without undue delay and in any case no later than 14 days from the day you informed us of your withdrawal from this Agreement. The deadline is met if you send the goods back before the 14-day period has expired.
